Please read the Terms of Use for your Consultation carefully and in their entirety before submitting your tuition deposit and scheduling your Admissions Interview. 

1.  Definitions

“Company”, “We”, “I”, “Our”, “Us” or “IFCI” means International Fibromyalgia Coaching Institute, LLC.

“Participation”, “Participating”, “Using”, or “Use” means submitting your tuition deposit and/or engaging in the Admissions Interview.

“Interview” means the Admissions Interview.

“You” “User” or “Your” means the person submitting the tuition deposit and scheduling and attending the Admissions Interview.

2.  Consent

By participating in the Interview, you implicitly and voluntarily agree to act in accordance with, and abide by, these Terms of Use.

3.  Relationship 

While you have submitted a tuition deposit and scheduled an Admissions Interview with IFCI, you understand that no coach-client relationship is being formed between you and IFCI.

4.  DISCLAIMER

The purpose and goal of IFCI’s work is to educate and connect potential clients and fibromyalgia patients, like you, with qualified training programs and fibromyalgia coaches who have been trained and certified by IFCI. 

By participating in the Admissions Interview, you understand that we are not medical doctors, psychologists/psychiatrists, or other licensed medical professionals. You are expected to discuss any changes to your health, diet, or exercise regimen with your physician or another medical professional first before trying them.

This Admissions Interview is for informational and educational purposes only. The information and education provided in this Interview is not intended or implied to supplement or replace professional medical treatment, advice, and/or diagnosis.

Although we do our best to make sure all of the content in your Interview is up to date and/or accurate, we do not make any representation that all the information is accurate or free of errors at all times. We do not assume any responsibility for accuracy of the information given during your Interview, or its safety or efficacy as it applies to you. You should review any and all changes to your diet, lifestyle, exercise regimen, or supplement routine with your medical professional.

5.  Refund Policy

By scheduling the Interview, you are holding a space on our calendar that is no longer available to other clients. Therefore, there are only two times your tuition deposit will be refunded:

A) If you attend your Admissions Interview in good faith and we determine that joining one of IFCI’s training programs isn’t a good fit for you at this time, your tuition deposit will be refunded, minus a $25 return fee to cover bank processing charges.

B) If you cancel your Interview a minimum of 24 hours in advance, your tuition deposit will be refunded, minus a $25 return fee to cover bank processing charges.

Outside of these two situations, IFCI is not able to offer refunds once you have paid your tuition deposit and scheduled the Interview. You understand this provision and agree that you are not entitled to a refund once payment has been issued to IFCI.

Further, you agree and understand that changing your mind about the Interview, cancelling the Interview less than 24 hours in advance, failing to follow through or understand how to attend the Interview, not experiencing the results you expected or desired, or experiencing any other similar situations does not entitle you to a refund of the tuition deposit. 

Any tuition deposits made will be applied in full towards your tuition once you enroll in the IFCI training program of your choice.

6.  Appointment Cancellation & Rescheduling Policy

Please understand that when you cancel or change your appointment without giving enough notice, we miss the opportunity to fill that appointment time, and clients on our wait list miss the opportunity to receive our help.

If it becomes necessary for you to cancel or reschedule the Interview, please contact us at least 24 hours in advance. As noted in our Refund Policy (#5 above), there are no refunds for cancelled Interviews unless the Interview is scheduled more than 24 hours in advance.

To cancel or reschedule your appointment, please email us at admissions@ifcinstitute.com or use the Change/Cancel Appointment link in your appointment confirmation email.

If you do not cancel at least 24 hours in advance, you will forfeit your tuition deposit. If there are extenuating circumstances and you would like to reschedule your Interview, email our team at admissions@ifcinstitute.com for consideration.

7.  Late Appointment / No-Show Policy

Any late arrival will shorten your appointment time and will not be made up by running into the next client’s scheduled appointment. 

If you are more than 10 minutes late for the Interview, we will do our very best to reschedule the Interview for another time that is convenient for you.

If you are more than 10 minutes late for the Interview a second time, it will be treated as a cancellation with less than 24 hours notice.

8.  Confidentiality 

This Terms of Use is considered a mutual non-disclosure agreement, meaning both you and IFCI agree not to disclose, reveal, or make use of any confidential information learned by either party during discussions, calls, emails, or otherwise. 

IFCI will not disclose or share any confidential information learned as a result of your Admissions Interview and will continue to keep your confidential information private even after the relationship between you and IFCI has ended.

9.  No Claims Made Regarding Results

Any and all current or past-client testimonials, statements, or examples used by us are simply that: examples. They are not guarantees that you will also experience or receive the same results. Each person and their circumstances are unique and nothing shall be interpreted as a guarantee that you will experience the same results as another client of ours. 

10.  DISCLAIMER – No Warranties, Guarantees, or Representations Are Being Made

We do not offer any representations, guarantees, or warranties, of any variety, regarding the Interview in any way. The Interview is offered “AS IS” and without representations, guarantees, or warranties of any kind, including but not limited to, implied warranties of merchantability and fitness for a particular purpose, neither express nor implied, to the extent permitted by law.  We are not liable for damages of any kind related to your use of information provided during the Interview.

11.  Your Release of Us, Indemnification, Hold Harmless

To the fullest extent permitted by law, International Fibromyalgia Coaching Institute, LLC expressly disclaims liability for any direct, indirect, and/or consequential damages suffered by you related to your purchase or use of, or participation in, the Interview, its materials, our website, or any other information obtained by you from us. By scheduling the Interview, you hereby agree to this limitation of liability and release International Fibromyalgia Coaching Institute, LLC from any and all claims.

By submitting your tuition deposit and participating in the Interview, you agree to release, forgive, forever discharge, defend, indemnify, and hold harmless International Fibromyalgia Coaching Institute, LLC, our subsidiaries, employees, agents, contractors, subcontractors, shareholders, directors, officers, coaches, students, assignees, licensees, and affiliates from any and all claims, suits, actions, charges, demands, liabilities, damages, judgments, and/or costs, related to, or arising out of, your purchase of or participation in the Interview and/or your breach of any obligation, warranty, covenant, or representation set forth in these Terms of Use. 

By scheduling the Interview, you agree to release us from any and all claims, and further agree to at all times defend, indemnify, and hold harmless International Fibromyalgia Coaching Institute, LLC as stated in this section herein. 

12.  ARBITRATION CLAUSE

If you have any complaint or should any issue arise in the use of the Interview, please contact us directly first by emailing the IFCI team at admissions@ifcinstitute.com.

However, if we are unable to amicably resolve your dispute in that manner, you agree that you and International Fibromyalgia Coaching Institute, LLC. shall submit your dispute to binding arbitration with the American Arbitration Association, before an arbitrator that is mutually agreed upon, in accordance with the American Arbitration Association’s (“AAA”) rules.

By agreeing to this term, you hereby agree and understand that you are waiving your right to a jury trial in court, which would otherwise be available to you if not for this Arbitration Clause. Should any arbitration hearing need to be held, it shall be held within 50 miles of Seattle, Washington.

If the arbitrator issues an award and a judgment is made, the judgment will be binding and will be entered in court in the State of Washington. The only award that can be issued to you is a refund of any payment made to International Fibromyalgia Coaching Institute, LLC for the tuition deposit and applicable Interview. You are not permitted to seek additional damages, including consequential or punitive damages.

13.  Limitation of Liability

Tami Stackelhouse and International Fibromyalgia Coaching Institute, LLC are not responsible or liable in any way for any and all damages you receive directly or indirectly from your participation in the Interview. We do not assume liability for damages, injuries, harm, death, misuse of (or failure to properly use) the Interview or its content, due to any act, or failure to act, by you. IN NO EVENT SHALL WE BE LIABLE TO YOU FOR ANY INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES.

14.  PAYMENT, PURCHASE, AND PAYMENT PLAN TERMS

When you pay the tuition deposit by credit card, you authorize and give permission to International Fibromyalgia Coaching Institute, LLC to charge your credit or debit card for the amount owed for payment of the tuition deposit. When you submit your tuition deposit, your information (i.e. credit card and contact info) may be collected by the third-party merchant Square and Squarespace (Acuity Scheduling), who may have privacy policies or security practices that are different than ours. International Fibromyalgia Coaching Institute, LLC is not responsible for the merchants’ independent policies or practices.

15.  Severability 

The provisions of these Terms of Use shall be deemed severable, and the invalidity or unenforceability of any provision shall not affect the validity and enforceability of any other provision hereof. If any Section, subsection, sentence, or clause of these Terms of Use shall be adjudged illegal, invalid, or unenforceable, such illegality, invalidity, or unenforceability shall have no effect on the Terms of Use as a whole or on any Section, subsection, sentence, or clause hereof not expressly so adjudged.

16.  Entire Agreement

These Terms of Use contain the entire agreement between you and the Company. There are no other promises or conditions in any other agreement (oral or written) between you and the Company.

17.  Choice of Law + Venue

These Terms of Use shall be governed by the laws of the State of Washington. Any action brought by any party arising out of or from these Terms shall be brought within King County, Washington.

By submitting your tuition deposit and/or participating in the Interview, you implicitly signify your agreement to all of the terms in these Terms of Use.
